Please read these Terms of Use ("Terms") carefully before using the Jewel ID mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
Jewel ID provides AI-powered jewelry identification and valuation services. The App allows you to:
- Scan or upload photos of jewelry for identification
- Receive AI-generated analysis of jewelry type, materials, gemstones, style, and era
- Obtain estimated valuations for jewelry pieces
- Save identified items to a personal vault on your device
Important Disclaimer: All identification results and valuations provided by the App are AI-generated estimates. They are not professional appraisals and should not be relied upon for insurance, sale, or legal purposes. For accurate valuations, please consult a certified jeweler or appraiser.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device for your personal, non-commercial use.
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any unlawful purpose
- Remove any proprietary notices from the App
4. Subscriptions and Payments
4.1 Subscription Plans
The App offers subscription plans that provide access to premium features. Subscription options and pricing are displayed within the App.
4.2 Billing
All payments are processed through Apple's App Store. By subscribing, you agree to pay the applicable subscription fees. You are responsible for all charges incurred under your account.
4.3 Auto-Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you were originally charged.
4.4 Managing Subscriptions
You can manage your subscription and turn off auto-renewal at any time through your Apple ID account settings. To cancel, go to Settings > [Your Name] > Subscriptions on your device.
4.5 Cancellation
If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period. No refunds will be provided for any unused portion of a subscription period.
5. User Content
You retain all ownership rights to the photos you submit to the App ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to process and transmit your content solely for the purpose of providing the App's analysis services.
6. Usage Limits and Fair Use
To ensure fair access and optimal performance for all users, we implement usage limits:
6.1 Analysis Limits
Free and premium users are subject to analysis limits. Specific limits for each tier are displayed within the App.
6.2 Fair Use Policy
These limits are designed to ensure fair access for all users and prevent system abuse. We reserve the right to:
- Adjust these limits at any time without prior notice
- Temporarily extend or reduce limits for individual users at our sole discretion
- Implement additional restrictions based on system load, user behavior, or operational needs
- Throttle or temporarily suspend service for users who exceed limits
6.3 Excessive Usage
Usage that significantly exceeds stated limits, impacts system performance, or appears to be automated or abusive may result in:
- Temporary analysis delays or throttling
- Temporary suspension of analysis capabilities
- Permanent account suspension in cases of severe or repeated violations
We will make reasonable efforts to notify users before taking action, except in cases of severe abuse or security threats.
6.4 Premium Subscriptions
Premium subscribers may receive higher limits or priority analysis. Specific limits for each subscription tier are displayed within the App and may be adjusted periodically.
7. Prohibited Uses
You agree not to:
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems, networks, or other users' accounts
- Interfere with, disrupt, or place excessive load on the App, servers, or networks
- Use automated means (bots, scripts, scrapers) to access or use the App
- Circumvent any technological measures, rate limits, or usage restrictions
- Use the App to analyze content you do not have the legal right to use
- Resell, redistribute, or commercially exploit the App's services without authorization
- Attempt to reverse engineer, decompile, or extract source code from the App
- Create multiple accounts to circumvent usage limits or restrictions
- Misrepresent AI-generated valuations as professional appraisals
Violation of these prohibitions may result in immediate suspension or termination of your access to the App, with or without notice.
8. Intellectual Property
The App and its content are owned by us and protected by intellectual property laws.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED. AI-GENERATED IDENTIFICATIONS AND VALUATIONS ARE ESTIMATES ONLY AND MAY NOT BE ACCURATE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ANALYSIS RESULTS.
10. Limitation of Liability
WE SHALL NOT BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP. THIS INCLUDES, WITHOUT LIMITATION, ANY DECISIONS MADE BASED ON AI-GENERATED VALUATIONS OR IDENTIFICATION RESULTS.
11. Indemnification
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the App, your User Content, or your violation of these Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
Reasons for termination may include, but are not limited to:
- Violation of usage limits or fair use policies
- Abuse of the service or attempts to circumvent restrictions
- Fraudulent activity or payment disputes
- Violation of intellectual property rights
- Any conduct that we determine, in our sole discretion, to be harmful to the App, other users, or our business interests
Upon termination:
- Your access to the App and all analysis capabilities will be immediately revoked
- Any pending analysis may be canceled
- You will not be entitled to any refund of subscription fees for the remaining subscription period, except as required by applicable law
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App. Your continued use of the App after any changes indicates your acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
15. Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
16. Apple App Store Terms
The following additional terms apply to the App when downloaded from the Apple App Store. You acknowledge that these Terms are between you and us only, not with Apple Inc. We, not Apple, are solely responsible for the App and its content, maintenance, support services, warranties, and any claims relating to the App.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
